Official Campaign Rules

 

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF RECEIVING AN INCENTIVE. VOID WHERE PROHIBITED BY LAW.

These Official Campaign Rules (“Rules”) for the 2025 Employer Incentive Campaign (the “Campaign”) sponsored by the CalSavers Retirement Savings Program (“Program”) are written in accordance with California Code Regs. Tit. 10 §10012 (“Campaign Regulations”).

  1. Eligibility. Participation is open only to eligible employers with an average of five or more employees for a calendar year who have been notified by the Program of their requirement to register by December 31, 2025 and employers with four or fewer employees required to register with the Program by December 31, 2025 (“Employers”), as described in the Campaign Regulations.
  2. How to Participate. An Employer must do the following to participate in a drawing (“Drawing”) for a chance to receive an Incentive (defined below): (1) register and establish a payroll deposit retirement savings arrangement with the Program for at least one participating employee between January 1, 2025 and November 30, 2025; (2) facilitate at least one contribution for the participating employee(s) between January 1 and November 30, 2025; and (3) continue to facilitate contributions to the Program for the participating employee(s) as required by law. Employers with four or fewer employees that registered with the Program prior to January 1, 2025, and have maintained compliance with the Program by facilitating contributions for at least one employee will be automatically entered into the first Drawing.
  3. Drawings. There will be two Drawings --the first for Employers who complete the requirements set forth in Section 2 from January 1, 2025 to July 31, 2025, and the second for Employers who complete the requirements from August 1, 2025 to November 30, 2025. Employers who register with the Program before July 31, 2025 and who are not selected as a recipient in the first Drawing will be automatically entered in the second Drawing if they have maintained compliance with Program rules.
  4. Odds. The awardees for each Drawing will be selected at random from among all Employers who complete the requirements during the applicable period for each respective Drawing as set forth in Section 3. The awardees will be selected via random number generation. Up to 1,000 awardees will be selected from each Drawing. In the event the Drawing contains 1,000 or fewer Employers, all eligible Employers who were entered shall be awarded an Incentive.
  5. Incentive. The awardees will receive a cash award in the amount of FIVE HUNDRED DOLLARS ($500) (“Incentive”) sent via Electronic Fund Transfer to the Employer’s bank account used to facilitate payroll contributions to the Program, or to their registered mailing address by personal check. Allow 180 calendar days after the announcement of awardees for the distribution of the Incentive. Potential awardees are subject to eligibility verification by the Program, whose decisions are final and binding in all matters related to the Drawing. Recipients must maintain compliance with the Program after being announced as an Incentive recipient in order to receive the Incentive. An Employer may not receive an Incentive unless and until the Employer’s eligibility has been verified. Participating Employers may only receive one Incentive. The Incentive is non-transferable. The Program is responsible only for delivery of the Incentive; not responsible for Incentive utility or otherwise. The Drawing does not take into account a recipient’s personal circumstances or other factors that may be important in making financial decisions. The recipient should consult his or her own tax advisor about tax implications, if any, associated with receipt of an Incentive. The Incentive may be considered income, and any and all taxes associated with an Incentive are the responsibility of the recipient.
  6. Notification. The CalSavers Retirement Savings Board (the “Board”) will announce the Employers eligible for the Drawing by publishing a list of the employer business names on its website at least ten (10) days before a Drawing. Employers will be assigned a number at this time. The Board will select and announce awardees at a board meeting or at a public hearing held by the Executive Director of the Board or their Designee, in which the numbers of the winning Employers will be called. In the event a public hearing is held to announce awardees, Board staff shall provide notice of the time, date, and place of the hearing by publishing said details on the Board’s website (treasurer.ca.gov/CalSavers) and by mailing or emailing the notice to every person who has filed a request for notice with the Board no less than ten (10) calendar days beforehand. No more than the stated number of Incentives will be awarded. In the event that production, technical, seeding, programming, or any other reasons cause more than the stated number of Incentives as set forth in these Rules to be available and/or claimed, the Program reserves the right to award only the stated number of Incentives among all legitimate, un-awarded, eligible Incentive claims. The Program is not responsible for, and shall not be liable for, late, lost, misdirected, or unsuccessful efforts to notify recipients.
  7. Miscellaneous and Conditions of Participation. This Campaign is void outside the state of California and where prohibited or restricted by law, and is subject to all applicable federal, state, and local laws and regulations. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Rules, or the rights and obligations of the Employer and the Program, shall be construed and governed by the laws of the state of California without regard to conflicts of law. All suits or claims brought in connection with the Campaign must be brought in a state or federal court in the state of California. Taxes and fees, if any, are the sole responsibility of the Incentive recipient(s). By participating in the Campaign, Employers fully and unconditionally agree to be bound by these Rules and the decisions of the Program, which will be final and binding on all matters relating to this Campaign, and warrant that they are eligible to participate in this Campaign. The Program reserves the right to disqualify any participating Employer if these Rules are not followed, and to change, alter, or amend these Rules or to alter, modify, suspend, or terminate the Campaign, as necessary, in its sole discretion, to ensure the fair administration of the Campaign or to comply with applicable law. The Campaign is not a recommendation to invest in the Program.
  8. Release. Each Employer agrees, except where prohibited by law, to release and discharge, hold harmless and indemnify the Program, its employees, agents and representatives, officers and directors and their immediate families, successors and assigns, and all others associated with the development and execution of this Campaign, from any and all tax liability that may be imposed or associated with receipt or use of the Incentive, and from and against any and all claims, actions, proceedings, and liability for any damages, expenses, fees, injury or losses sustained in connection with the receipt, ownership, use or misuse of the Incentive or while traveling to, preparing for, or participating in any Campaign-related activity.
  9. Publicity. Except where prohibited by law, by participating in the Campaign or by receiving an Incentive, Employers grant to the Program the right to publicize the Employer’s name without compensation and without opportunity for review.
  10. Limitations of Liability. The Program, its employees, agents and representatives, officers and directors and their immediate families, successors and assigns, and all others associated with the development and execution of this Campaign shall have no responsibility or liability for (i) any incorrect or inaccurate information, whether caused by participants, printing errors, or by any of the equipment or programming associated with or utilized in the Campaign; (ii) technical failures of any kind, including, but not limited to, malfunctions, interruptions or disconnections in telephone lines or network hardware or software; (iii) unauthorized human intervention in the administration of the Campaign; (iv) technical or human error which may occur in the administration of the Campaign; or (v) failed, incomplete, garbled, jumbled, corrupted or delayed computer transmissions which may limit an individual’s ability to participate in the Campaign, including any injury or damage to Employer’s or any other person’s computer relating to or resulting from participating in the Campaign or downloading any materials related to the Campaign.
  11. Employer Information. Information collected from Employers will be maintained by the Program and its representatives in accordance with applicable federal and state consumer privacy laws, rules and regulations.
